Legal Question in Real Estate Law in India
My father died intestate in 1997. At the time of his death, he had a house in Delhi solely in his name; a house in Hyderabad in the joint names of my parents, and 2 plots of land in his name in Chennai. He has four legal heirs, including me, my mother and 2 brothers. To facilitate various payments in respect of our Delhi house, we three brothers gave a relinquishment deed in favour of our mother. Now, can she make out a will leaving the Delhi house in favour of only one of us (brothers)? Can she also will the other two properties at Hyderabad and Chennai as she likes?

Delhi house can be willed by your mother in favour of any one of you.Hyderabad house which is in joint names of your father and mother , Your mother has 50% share in that property rest 50% has to be divided amongst you brothers and your mother. and 2 plots in chennai again has to be divided amongst all the 4 legal heirs .
