Legal Question in Real Estate Law in India
My father died 15 yrs back.He had a huge timber and wood businss in Meerut.After his death my mother remarried and transferred the entire property to my step father.Currently my mom is having 3 children from my step father,2 sons and 1 daughter.I m also doing wood business with my step father but nothing has been given on my name.Now sir,I want to know that what right do I have over the property and is it possible I can get any share from the property?Plz help.

At the time of demise of your father you were entitled to 1 share from the property of your father. If you are the only child from your Mother's first husband then you are entitled to 50 % of the estate.
Was the property in your fathers name when he was alive ? had your fathers transfered the property in your mothers name when he was alive ? Has your father died intestate ? First and foremost, since you are doing business with your step father, your interests are protected and safeguarded, if you are a partner in the business. Knowing your present status in the business is important. Further to what my learned colleagues have already pointed out, your mother cannot inherit a better title than what she had from your father. I mean, on the demise of your father, your mother and you were each entitled to a 50% share of the family property. Knowing the basis (documentation) for your mother then acquiring the entire family property herself is important.
