Legal Question in Real Estate Law in India
my father in law has passed away leaving behind a property in name of his 2nd wife and 3 daughters, having equal share of 25 % each. Now there is a dispute among my spouse and the rest three, my question is if they wish to sell the propery and if my spouse doesnt want to, then can the court of law force my spouse to sell the property as they have the majority of 3 and my spouse only 1. similarly if rest 3 dont wish to sell and my spouse wants to sell the property can the court of law help to us in this regard and technically speaking how many days does this case go on in the court and what would be the appx. legal charges applicable like lawyer fees and all.

The best solution in these kind of Imbroglio is buy out each other ie. one party can buy out the other party. Lawyers fees varies.
till the time the dispute is not decided, the status quo may be maintained and no party would be allowed to sell the property. there is no time limit for the case to reach at the stage of judgment.
Undivided share may be sold.
Court matters have no fixed time schedule.
