Legal Question in Real Estate Law in India
My father has 6 legal heirs and has left a registered will with major portion of the benifits to one of the children. Is is necessary to get the will probated? Can the mutation of the property be done in the records of the MCD?

If there is no dispute amongst the legal heir in terms of share given to them according to the will then probate proceedings are not required. Yes the mutation of the property can be done in MCD records.

Check whether the concerned State or UT Govt notified for mandatory probate. If probate is not made mandatory, one may act on the basis of Will without a probate.
