Legal Question in Real Estate Law in India
Our father has purchased a piece of agriculture land way back in 1987. Though the full consideration was paid by our father the same has been registered in the name of my elder brother. My father passed away and now after his death we want to divide the share equally among all three of us. What is the best remedy in the Delhi Courts so that without paying any stamp duty the same can be equally divided. Is relinquishment deed or partition deed applicable or should we file a suit a family settlement in the Delhi High Court?

as the land is in the name of your elder brother, is he ready to part with the portion of land? if not, you may have to contest the case and prove that the consideration was paid by your father. but this would be affected by benami act.
