Legal Question in Real Estate Law in India
My father purchased property in 1980 by paying through his bank account but in my name. I was a student dependent upon father at that time. I am regd. owner.I am out of the property & the same is in the possession of my brother.Is this a HUF PROPERTY or a Benami property.

If u r regde.owner then u have no problem u r owner and u can file police complaint and may file civil suit and u may claim rent

It is a Benami transaction but no wrong you as a matter of registered owner can claim the possession and ownership as if the property is purchased by you and can make an amicable settlement with your brothers and others who are solely requires that property.
