Legal Question in Real Estate Law in India
My father has tried to sell inherited property i.e of Grand father. He is deaf and dumb and is divorced since more than 20 years but he was always having eager for marriage and has done 3 or 4 marriages un officially and the group which is showing different girls for marriage has taken 2-3 lacs till date and also has taken few blank cheques as well as signature on stamp papers as soon as we came to know all this things. We have approached advocate who has file case against him in the civil court for the stay order of the inherited property as my grandfather has done will in favour of me as well as my elder brother.
Now suddenly one person whom we don't know is claiming in the court that we have sold this property to him (his wife) and is showing agreement for this. Also he has filed case in Police station claiming that against we both brothers that we have dealed with him. But fact is that we have not deal with him and even we have not taken any money from him. We have seen the agreement through court that sign is done by our father. Also we dont know any financial understanding. Right now property is under us and is locked by us. Now without any reason police is calling us and asking for statement. We dont know anything about the deal even we have not given any NOC or signed any agreement for sale.?
Please give us the solution as it is mental as well as financial harrasment done by that person. Please guide us what we should do in this case. ? Our lawyer is saying that you dont need to worry documents will be cancelled but what about the FIR done against us without any reason ?

you may apply for anticipatory bail and then contest it on facts. This will depend upon the evidence you have
