Legal Question in Real Estate Law in India
My father is going to transfer his property to my and my mom�s name; after my mom�s death, the property is to be solely owned by me. I do have one sister, who has been compensated by me in cash. Would a will executed by my father and a NOC to the transfer from my sister suffice, considering my mom's right will fall to me only after she passes away?

It will still be better if your sister, who is being ousted from the property, signs on the will as a witness.

Two transfers are expected to be done in your case, firstly by father in favour of your mother and then mother to do in your favour. in both the cases, sister is to be debarred. Have sister as witness in all such transactions as suggested by Mr. Goel.
