Legal Question in Real Estate Law in India

An old father transferred his property in favour of his son through Special Power of Attorney without any consideration on the assurance that sone will take care of father. Now son wants to sell property throwing away the father. The old father wants to cancel Special Power of Attorney. How he can get his right to property back.

Revoke & cancel power of attorney by giving notice/letter to power of attorney holder and also publish a notice in local newspapers. You may consider informing concerned offices where this power of attorney is likely to be used.

You may revoke the SPA by issuing a notice to the party by mentioning the time of revocation wef from the notice date or earlier.

Mr.Nahar is quite right. Father can cancel the SPA and get back the property.
