Legal Question in Real Estate Law in India

what i do when i know that my flat which have been taken from builder by home loan from a bank and live from 1st day. after ten years it has been came my notice that one of other bank affix a symbolic possession notice on the building wall for same flat. to another name who is not in picture nither seen from 1st day to till date .

If bank has taken symbolic possession under SERFESI Act you need to engage a lawyer and approach DRT by way of appeal, and get it cancelled. Independently; you may also identify as to who is the guilty one; and initiate appropriate Civil and/or Criminal action against such person.

Since there is a bank loan involved, you should :

1. Confirm the genuineness of the notice and if you are living in a registered Co-operative Housing Society, please check for authenticity of the notice with the Secretary;

2. Ask for an explanation in writing from the builder;

3. Draw the attention of the bank who gave you the home loan to simultaneously initiate action in the matter.
