Legal Question in Real Estate Law in India

I have a flat in chennai India which i have given on rent to a single lady. The tenant is using the house for business purposes. The flat is in a building which is around 3 years. The tenant has not paid rent for nearly 10 months now. She agreed to vacate the house by end of December 2011 which she has failed to do. In January 2012 she obtained a stay order against vacating the house until end of Feburary 2012. Still there is no news from her. As she obtained a stay against vacating the house, we also engaged a lawyer to handle the case. The lawyer has also not filed a counter petition or a eviction notice although it is 3 months since the tenant got the stay order. The lawyer is also delaying filing any petition and he is just taking vaidha to postpone. Can you please suggest what should be we do under the current situation. Is the delay by the lawyer normal or is he siding with the tenant. Should we change the lawyer to move the case forward. Please suggest good and reliable lawyers in Chennai to get a second opinion and get a status update of the case as of now.

Delay is never normal atleast so far as the filing of petition/eviction notice is concerned. you should take up the matter with your lawyer or else should see the next hand

Since Rent Laws are local law, a local lawyer may be of some help to you.
