Legal Question in Real Estate Law in India
I own a flat in a co-op. hsg. sty. in Mumbai. I have been staying in the said flat since past 20 years. The society was registered in 1968. The society has not adpoted the new model bye-laws and continues to function as per the old bye laws adopted at the time of its formation. The number of cars possessed by eligible members (one each) is in excess of parking space available. The society follows "First Come First Served" policy for allotment of car parking space. Consequently some of the members are enjoying the parking for several years whereas some have to park their car on the road. Inspite of repeated request by the deprived members - who are in minority, the managing committee is unwilling to alter its stand. Please guide what are the possible remedies available to the deprived members. Thanks

You may move an application to the society or corporation or may file civil suit
