FLAT IN co-operative society

my father paid 50% to my grandfather for purchasing the flat in 68.he expired in 72 leaving grandmother as nominee and so flat was transfered on her name.she inturn propsed my father as nominee in 73.she expired in 2004 and as such name was transfered on my dad's name.now my chacha is claiming a share in property.we agree to pay him 1/3rd of the 50% percent since 50% orignal payment was done by my dad for purshase and they are 3 brothers.he insists that it should be 1/3rd of the entire 100%.pls suggest?

You are right; your chacha may be entitled to only one sixth; let him try his luck in the court.
