Legal Question in Real Estate Law in India

I have taken a flat on lease and license basis in Mumbai. The minimum lock in period is for 12 months. If i vacate without completing 12 months i need to pay for the entire 12 months (as per the agreement). Due to rainy season in Mumbai, the flat has started leaking and water is all around in the flat. In given conditon can i leave this flat without paying any fine. There is no such clause in the agreement though and neither owner had told me before talking this flat. Please help

You can send a legal notice to the landlord detailing the inconvenience.
