Legal Question in Real Estate Law in India

A flat is owned jointly by 3 brothers. One of whom has relinquished his rights and those of his legal heirs by giving a affidavit that has been duly notarized. However he refuses to sign any of the society transfer forms or sign any other release or relinquishment deed and hence I want to know the alternative procedure to have his name deleted from the society and the share certificate transferred accordingly to the other two brothers whose names already exisit on the share certifciate. Incidentally this brother�s name is second on the share certificate.

You may first complete the "relinquishment proceedings". The title of an immovable property valuing more than Rs.one hundred has to be only by way of a registered document.
