Legal Question in Real Estate Law in India
i have one flat in pune which is on name of my grandmother. She is dead on 1995. After giving proper share transfer paper society had done nothing. Now accourding to my grandmother's will i am only soal holder of that flat. That will is not register and now from 1995 my uncale and aunty live in that flat and paid maintainance. As per that will I cant sale that flat till my parents or my ungle and anty are alive. My mother and my ungle were dead last year in 2011. Now only my father who lives with me in Mumbai and my anty lives in pune flat with her divoice daughter in pune's flat. Now when I want to put my name in that flat and on share certificate society members and my cousin is takeing objection. Society misplace my original share certificate. Societies Chairman himself sign as wittness on my grandmother's will means he know everything. That time my father is associated member with my grandmother. And as per our papers I am nominee of that flat but that copy is not acknowledge. Our Society don't have any proper papers with them. Now I want to ask What i Shall do to transfer that share and flat on name? Also my cusion have any right to fight with me? They are paying flat maintainance for last 15 years so there is any problem for that. Please help me.
