General POA
Hello,
I am planning to buy a site in Bangalore, India and hence want to give General POA (Power of Attorney) to my sister. Please let me know if General POA needs to be attested by Consulate general of India here in US or is it okay if I get it notorized by notary public of US and then send the same to India. Also please let me know if it needs to have witness signatures. If possible please let me know the complete procedure for sending POA to India.

Yes, you must get it attested by Indian Embassy - no further witness is necessary. Once it reaches India person receiving in India, should pay appropriate (differs from state to state) stamp duty. That is all requried to be done.

It is enough if the POA is attested by Notary of the US. POA should be attested by two witnesses, above the age of 18 and of sound mind. For further details regarding the drafting of POA, stamp duty payable, registration procedure etc. contact me at [email protected]

It is better to Attest before the consulate General of India, if it is not possible then get it notarised before the Notary with his seal and send it across to your sister, after which if she produces before the District registrar they will register the same and she can produce the same anywhere.

It is always better to get the document executed and attested before the Consulate General, Indian Embassy, and the said document needs to attested by 2 Witnesses, and after the same is sent to Bangalore, the beneficiary of the same has to present the document before the District Registrar within 90 days, for authentication.
