gift deed

my father has a self acquired flat in which my mother, my brother along with wife,and my elder sister who is unmarried stay. i am the youngest daughter and i am married , my father wants to gift the said flat to my elder sister,i and my mother have consent to the same , but can my father legally do a gift deed in the favour of my elder sister, without the consent of my brother and his wife?

Yes, he can execute a Dift Deed in favour of your sister. But ensure that the same gets registered.
