Legal Question in Real Estate Law in India
Gift Settlement
My father is aged around 56. His sisters have filed a case against the gift settlement. Before 20years my father and my grand parents purchased a land and the same was registered on name of my grand mother. But my father spent everything on his own to built a house on the purchased land. The land along with the house was later given to my father in the name of gift settlement with proper papers duly signed by my grand parents and 6 sisters of my father (4 were major & 2 were minor then). My grandmother died after 11 years of purchase of the land. Now my aunts have filed a case stating that my father has not taken care of my grandma she has then cancelled the settlement showing some duplicate documents. Please note that my father is paying the electricity bills and land tax for the house and the electricity connection and ration card is in his name.Mean while my father had already filed a case in return. We also came to know that the gift settlement once given cannot be revoked but how our aunts able to file a case stating that the same is been cancelled showing some forgery documents. Please let us know how long this case will go and our percentage of success.
