Legal Question in Real Estate Law in India

Good Day,

I am running a shop and its registry (stamp paper which states that piece of land is mine) is on my name.

Issue is:

I have misplaced or stolen by some one.

Please advice for following:

1) I have posted related to same in LAWGURU.com, and an honorable advocate has suggested (https://www.lawguru.com/answers/question/show/2ENNFaPXSl):

a) Do the FIR related to theft in local police station

b) Issue the public notice in local newspaper

c) Get the certified copy for same from sub - registrar

so that I can sell my shop if required.

2) Further query is:

a) If my shop registry is stolen, then thief can sell my shop or do some harm to me in term of money. I am working on my shop.

b) Can I make the new registry?

c) What type of proof I need to show to sub-registrar? And can I directly approach to sub-registrar office or do I need to go via a advocate? How many days normally it take to get the certified copy from sub-registrar office?

You have to register the lost of your registry to the police and then copy of the complaint is enough. Ge the same and approach to the registrar, he have all the records and he will supply you copy of the same. you may engage any lawyer, then you will not be harassed and he will perform everything for you and get the same from registrar office about one or two weeks.

In respect of loss anybody can misuse your registry.

You may like to apply and take a copy and keep with you for your record

since you hv the possession, there should be no problem. that is why I suggested the public notice

You may get the duplicate but not new until you sell it or gift it

No proof is required. Yes you may approach directly with out the assistance of any one including a lawyer. Maximum a week if particulars are correct

Registration of FIR is not must, unless you are sure about theft. In case of lost or misplaced deed, police won't register a FIR as there is no cognisable offence involved.

Except creation of mortgage by deposit of title deed, no other harm appears to be possible.

A new registry is not possible and same is also not permissible. However, you can get certified copy of your existing registry.
