Legal Question in Real Estate Law in India

we have got good properties acquired by our father and grand father. My father and grand father died in the year 1975. Now our brothers are sharing the entire property them selves and showing empty hand to the daughters. Can we claim property from them. They are telling some will is there not to give any share to the daughters but they are not producing to us. What to do now to get our share.

Yes, as per the provisions of the Hindu Succession Act, 1956 daughters have an equal right to a share in the family property. You need to ask your brothers to show you the original Will that they claim is left behind by your grandfather and your father which specifically states no share to be given to the daughters. And just for your information, even if there is a valid Will, the transfer and acquisition of the property to the beneficiaries of the Will, requires a Probate from the Court.
