Legal Question in Real Estate Law in India
My grand father (father's father) had 10 Acre agriculture land.
He has 3 Daughters and 4 sons(including my father 3rd Son).
After grand father death only edlest son was lookingafter and enjoying the entire asset.After that only my father filed a case against him and spend money & fought for 10 years and got the justice. According the judgement 3.4 acre was seperated & given to eldest one as per my father request because eldest son's earning is entirely depedent on this land. Remaning entire 6.6acre part is under 3 Daughters and 3 sons together.
Now situation is-- youngest bother (4th Son) is taken position of 6.6 acre and
alone enjoying the Land after he had a quarrel with us.
Question: 1) I , As a grandson of the family how can I stop my father's youngest bother alone going and enjoying the enire 6.6Acre Land though we are one of the share holders and also spent lot of money for the case?
2) Can we(grandchildren) file for equal rights (share) against the 2acre extra given to the eldest one?

You ask your father to file a Partition suit and get the lands partitioned. Regarding the already allotted land to the eldest brother you cannot do anything.
