Legal Question in Real Estate Law in India
Hi, My Grand Mother gave all her property to my mother on 1971. It was formally registered. Same year, My Grand Father gifted all his property to my mom's sister. He died next year (1972). My My Mom's sister sold all her property on 1992. In the year 1995, my grand mother wrote another will, which divides her property in to 2 equal parts, one each to my mom, and moms sister. We didnt know this till last month. We are paying property tax since 1971. We came to know this new deal between my grandmother and my moms sister when we tried to sell our property. My Moms sister is going to file a case claiming her rights in the property. Are we going to lose half of our property, which we look after for more than 40 years? If we lose, my moms sister will get 75% of total property of my grand parents. Please advise....

After execution and registration of deed of transfer of property by grandmother in favour of your mother in 1971, she ceased to be owner and your mother became owner. Therefore, your grandmother can not dispose of gifted property by her changed Will.
