Dear Sir / Madam,

Ancestral property passes to the persons to whom it has been specifically gifted or willed i.e if your grandfather has signed a Will tranferring the property in the name of his grand daughter.

In the absence of a Will, all the surviving legal heirs i.e grandfather's wife, sons and daughters will have a rightful claim on the property. A proportionate share will be transferred to the grand daughter's parents first, as the direct legal heirs. After this transfer has taken place, her parents can then transfer their share to their daughter.

You can claim your grandfather's property when he dies intestate only and not otherwise. For any further advice contact me at [email protected]
