Legal Question in Real Estate Law in India

Hello,

I have been married for almost 2.5yrs now. while the time of marriage my mother had gifted me a property (apartment) worth of 40lacs as my marriage gift. After the marriage my husband started harassing me to transfer that property on his name for which i did not accept and later on many quarrels happened on that finally my husband agreed to keep the property on joint name for that also i was against but finally my mother convinced me to do so. Now its been 2yrs iam not with my husband, he is staying in USA and he is not even taking me there, now iam not interested continuing the relation with him and i want my property back. I spoke to him regarding this matter he said he is ready to give the property back but he is saying he cannot come to india. Is there any procedure to take back my property from the joint litigation without my husband coming to india. Is there any possibility that he can complete the necessary formalities from USA itself and i can get my property back on my name.

Yes, he may execute all necessary documents in USA. On that basis, you may seek re-transfer of the property in your name. You may need to consult a local lawyer for preparing the necessary documents required to be executed by your husband in USA.
