Legal Question in Real Estate Law in India

I am from Pune, Maharashtra, India. Iwant to know about current contavercy going on about VAT on flat sale. In my case Agreement is done sept 2005. Major portion of amount paid from April 2006 to May 2007. Possotion was taken in May 2007. Registered Deed of Apartment was signed by me and uncondtional handover was done in May 2008. In Deed of apartment stats clearly declaration by builder that all taxes till date of possation are paid by him and flatholder to pay all taxes from the date of possation. There is not condition stating that VAT is pending to be paid. During the whole period of transaction I didn't received any notice or letter from builder demanding VAT. I request you to give me guidance about my liability in this case on demand of VAT from builder.

If your agreement or other writings with builder do not provide for payment of taxes like VAT, then you may not be liable for the same.
