Legal Question in Real Estate Law in India
Hi,
I have made a sale agreement where i am a buyer. The property is in Haryana and when we got in an agreement the Registration of Dwelling units were open but now the registration is not active. The seller couldn't come for the registration in the last agreed date because of some personal reason and our next agreed date is approaching. We did record our attendance officially in the registrar office. I am worried that if the registrations doesn't open this time my bank would take the cheque back with them and i don't know what to do since i have already paid 30% of the amount. The seller is not a good guy and i have to vacate the property that i sold to buy this new property. I am hoping that seller would give me the money back but if he doesn't what is the fastest legal way to get my money back from the seller. We have a contract where it was mentioned that if the sale is not executed on the said date the contract shall be treated as void and the money would be refunded. If the deals doesn't happen this time, I am no more interested in buying this property as there were couple of issues (Map and GPA) with the title as well which has been resolved now.

Approaching court is the legal way. However, it is not fast.
