Legal Question in Real Estate Law in India

Hi,

My mother had signed a paper called banakhat that was not on stamp paper and not registered for the sale of her flat. She was given a partial payment of 2 lacs for the sale amount that was 45 lacs. Now she does not want to sell it and wants to return the money back but the purchaser is not willing to quit the buying process.

Can that banakhat or note written by my mother be enforceable by him.

It depends on the clauses of the agreement, whether cancellation is possible or not. www.lawconcern.com
