Legal Question in Real Estate Law in India

Hi,

My question is regarding valuation of suits. If I want to file a suit for partition of joint property to get my share, what is the court fee payable. Is it based on the market value or what.

Also, if I institute a suit against my brother who has possession of a property for the past 15 years, do I still need to pay court fee.If so how much. Will it be based on the value mentioned in the registry or the market value at the time of initiating the suit.

Check local court fees act/rules framed by the concerned state govt.

as you not in possession of the property, you need to pay the court fee for instituting a suit for partition.
