Legal Question in Real Estate Law in India

hi,

my name is ullas.I am 31 years of age and i have a legal problem. i lost my mother when i was 17. a couple of years later my dad got married to another woman with whom he has fathered a kid. Now he wants to sell the house which was bought when i was young and when my father was married to my mother. the house is in the name of my father but my mother was a working woman and has contributed to the house but there are no records to prove on paper i believe. Now my father plans to sell the house but he doesnt really seem to be interested in giving me a share. I would like to know what are my rights to my house built by my mom and dad. how much can i claim. i am not greedy i just want to know my stake and my rights. since there are 5 members associated with the house i.e. my dad, mom, myself, the stepmother, and the daughter. i suggested share the house among the 5 where everybody gets an equal share of 20 %. so i get my mother's 20% and mine 20 % the rest 60 % belongs to my father's new family. You have to please help me out here. I am not interested in going to the courts and battling out for ever. But I would really feel cheated or orphaned if my dad took all of it and didn't gimme my share as if me and my mother never existed and dont have any rights to the house.

thank you,

ullas

If property is a self acquired property of father and held by him in his own name, then you have no rights or say about sale thereof during life time of your father.
