Legal Question in Real Estate Law in India
I am a Hindu housewife. My husband have an ownership flat in a registered society. My husband passed away without making any nomination or will. He is survived by his wife (myself), an unmarried son and an unmarried daughter. As per law, I think the flat will be transferred in my name. But since my son manages all the house hold affairs, and we want to take a loan on the flat, is there a procedure that this flat be transferred directly to my son's name? Kindly advice.

The premise may be transferred in the name of your son with your and your daughter no objection certificate.
