Legal Question in Real Estate Law in India
I am hindu from madhya pradesh and the only daughter of my mother and I dont have any brothers or sisters. My father expired when I was 8 year old. My mother herself brought me up with her earnings. She might have got some amount or property from my father. I am married now. I want to know the following things:
1. Do I have right on my mothers property and bank accounts (after her death)
2. My mother have no much relations with her inlaws after death of my father. Can my mothers inlaw can claim right on the mothers property by showing that it was my fathers property.
3. Can my mothers brother, her mother (my nani) can claim right on my mothers property.
4. What can happen if the will is not prepared by my mother.
5. Can I ask for rights in my fathers father property. Actually everything from my father was confisicated by my fathers brother after his death.
Kindly advice so that I may get my rights as I dont want my mothers property to be distributed which she has gathered working hard throughout her life.

The answers are as follows:-
1) Yes
2) By showing that the property was of her son ,your Grand Mother can create problem for your mother but it is unlikely as she has not done anything in this regard for so long and would do anything now.
3)Only your nani can claim her right over your mothers property but your mother can will it to you..
4) Your mother dies intestate then you and your nani are the legal heirs of your mothers property.
5)No. you have no right in your grand fathers property.But what ever share your father had in his fathers property you , your mother and grand mother (dadi) can claim that much only and nothing more.
