We have a house in my mother's name (It was purchsed by her with air from her father). I am the only son and I have one sister alive and one sister dead and this sistem has a daughter who turns 18 in another 3-4 months time. I am planning to demolish the house and constuct the house and mother is Ok with that since she lives with me. But she is not willing to do Gift Deed. SInce the construction will cost be 40-45 lakhs i just wanted to check can anybody other than me claim the property - a. when my mother is alive b. If the mother dies without making a WILL

Daughters (or their pre-deceased children) inherits equally with the sons on the death of their parents (father or mother).
Construction on the joint property would be treated as joint and it is at your own risk to construct, law is settled regarding the ownership and inheritance of joint properties irrespective of gender element.
