Legal Question in Real Estate Law in India

My husband had booked a villa by paying almost 25% of the cost of the villa in a posh area in Banagalore in 2001

He expired within a few months of booking that villa.

An executive of the marketing team of the builder saw the obituitary of my husband in the papers and came to return the advance paid the very next day

What I feel is that he tried to time me out of the deal by taking advantage of my situation and giving me the money at the most emotionally strained moment in my life.

Now these same villas are worth crores and the house rent on them alone is 1L per month which I have lost for the last 7 years.

Kindly tell me if i can file a case against them for doing this too me since I took the money from them when they came to return it. They dint pay a penny more or anything, they just returned the advance we paid immediately after my husbands expiry.

This is so unfair, but do I have a case? How to go about?

Were you paid by cheque or payorder ? And if you were paid by cheque , who was the drawer of the cheque ? Did you sigh any document after or before receipt of the cheque and its encashment . Do you have any papers relating to the booking of the Villa by your husband ? Have you done anything in writing or otherwise with respect to this matter ? Give me the details as mentioned herein above and i hope that i would be able to get justice for you.
