Legal Question in Real Estate Law in India
My husband is envolved in extra-maritial affair. I want to get transfer the flat in which we are presently residing on my name. The flat is mortgaged with bank (Housing Loan) and is on the name of my husband. He is ready to pay the loan installment (E.M.I.). What procedure will have to follow to transfer the said Flat on my name. Is any registration is required for this? Will housing loan affect on the said transfer?

the loan can only be transferred once the bank is satisfied that you are capable of paying the EMIs otherwise the same cannot be transferred. transfer of loan is facilitated by certain banks but u need to prove that you financially capable of paying off the loan.
