Intricacy of benami act 1988.

(#) Is it correct that when a benamidar is NOT IN POSSESSION of the property on the date of the suit the provisions of the act are NOT APPTICABLE?(#) The act is NOT applicable if the sale deed is for the year earlier than the year of the benami act 1988 as the provisions of the act have been ,in fact, declared prospective in toto.
