Joint hindu family property

I am is the second wife son.My father sold 6 Acars Land without taking my consent. Sale is made before 11 months. Now Can I ask for partition of the Joint Hindu Family property from the father during his life time and Can I get share from already Sold property. Can I file suit file a case without considering Section 8 of Hidu Sucession Act. Please give me reply in details.

A suit for partition can be filed and you can claim the Joint Hindu family property. When your father is alive, Section 8 of the Hindu Succession Act does not come into picture. Section 8 applies to Hindu male dying intestate, and after him property shall devolve upon his heirs as envisaged in the Section.
