Legal Question in Real Estate Law in India

An land sale agreement was made on May 2009 with one year validity & 90 days expiration. It was registered. Now, the buyer had not turned up as he is short of money as well he is not coming up to cancel the agreement to clear the encumbrance. Please advise how to clear the encumbrance

you need to issue a notice to the buyer indicating all the facts and then cancel the agreement

An agreement may be cancelled by a court in suit instituted with appropriate prayers.
