Legal Question in Real Estate Law in India
I am Landlord in Chandigarh, also i am an NRI, in Jan 2010 i gave ground floor of my house on rent and came back abroad, the tenant paid security of 1Lakh and gave post dated cheques for Feb and onward, The feb rent went through and than he has put stopped payment on the rest of the cheques and emailed me that he will vacate the property on April 30th and these 2 months rent should be adjusted towards the security he paid (which as per our agreement was refunadable after he leaves the property) but anyways, now it looks like he is not going to vacate property on April 30th, i need some help, really appreciate if some one can guide me on this topic, i was under the impression that NRI's have a little different tenancy acts being in Chandigarh, the option i will be left is court procedings, and i dont know how long will it take to get my house back. PLEASE HELP!!!

you need to serve upon your tenant a legal notice for vacating the premise and also serve notice against the bouncing of cheque.
