Legal Question in Real Estate Law in India
The lease deed of the suit property was proved by the pltff.by summoning the clerk of the regd. authotity.However, the ownership was under cloud in view of serious objections raised by the def. in his w.s.The property is now proved 2 have been purchased from the funds of father. The lease deed has been declared a sham document & the transation has been declared a lose benami by the honarable court.The suit is thus dismissed.The pltff. & def. have been pronounced as co-owners.Now how the def. can claim full ownership in view of the fact if the plaintiff had won the plaintiff would had grabed the perantal property thereby deceiving the def.?
