Legal Question in Real Estate Law in India

I would like to have a legal advice on the property.

My Grandfather got the property from his father, after his death my father got inherited rights on the property, we are five brothers.

Now my father died 5 years ago, but my two brothers and mother had got registered will from my father, where he transferred the property rights to my Mother.

Now my mother and two brothers are playing the game and selling the partial property from this property and not giving any share to us(three brothers left).

My queries will be:

1. Can my father can willed the inherited property?

2. Can i challenge the sale deed of partial property which is happening on basis of this will.

3. How can i get my actual share in the property

The answers to your queries are here in below for your perusal :-

1) YES

2) You can create a problem but eventually you would loose it as it had become your fathers self acquired property and not Ancestral Property.

3) You have no share or right in this property but you can engage a lawyer to create a confusion and maybe your mother give in to your pressure .

It would be as per law of succession governing the deceased great grand father, grand father and father and nature of property.
