Legal Question in Real Estate Law in India
I really don't know about the legal terms involved while getting my house registered. Our Builder has cleverly retained some portion undivided land which is sufficient to construct 3 flats on the terrace and has also mentioned that the terrace rights belongs to him. Almost all the flat owners have blinded got their flats registered. Now, its the time to face the problems.
However, he is restricting us from entering the Terrace. He has locked the entrance door. Can he do such thing where we have our common area related Elevator Machine, Water Tank on the terrace? Moreover, he has constructed a room in the cellar parking area apart from the watchman's room and claiming that its part of his terrace rights. Can he construct rooms in the common area? Please suggest.
