Legal Question in Real Estate Law in India
In the Maintenance bill of my flat for this month there was an additional entry of Rs.2000 and the description said 'Other charges', upon inquiring with the Secretary he said that those were penalty charges for those who waste a lot of water (i.e. keep tap running and water flows continously).
I want to know whether it is proper to add any arbitrary charge to the maintenance bill.
We dont have a 24 hour water supply in our apartment, so it happens that a tap was left open when water was not coming in it, but in the morning as soon as the watchman releases water and hears the running tap he rings our bell. Also, there has been no such case that we have left a tap open and no one is at home, which has happened with others. Also, we have a storage tank in our house so sometimes when it gets filled it overflows. Also, since we stay on the ground floor its easier for them to point fingers, what about the person living on the seventh floor.
There was no prior warning given regarding this. Is this justified?
