Legal Question in Real Estate Law in India

I want to make a leave and license agreement and get it registered from 1.09.2010 for 11 months for house in which I am already staying on leave and license. However flat owner is staying in other city and can not come to sign documents, He is ready to give power of attorney to his brother for entering into leave and license agreement and register the same. My question is if power of attorney is given on 1st oct, can attorney sign on behalf of owner in agreement which is executed on 10th oct for lease with effect from 1.09.2010 and if yes what line is to be included in the POA and whether soomeone can provide me format for the same. Also whether POA for leave and license needs to be registered or notary is sufficient.

yes he may do so. What attorney is doing an agreement on a date when on 10th he has the authority to do so which he got on 1st. It may not be a bad idea to get this particular clause incorporated in the power of attorney that POA may enter into an agreement retrospectively also.
