Master document signed in 1999 between purchaser and vendor wherin the purchaser agreed to give two flats of 900 sq.ft each with terrace and monetary cosidertation of 2,50,000/- to the vendor, this was suppose to be completed within 3 1/2 years failing to which the purchaser will pay to the vendor Rs. 5000/- per flat per month as compensation. The purchaser did not commence the work on the said property, hence the vendor surrendered one flat under a supplementay agreement for Rs. 25,00,000/- in May 2003, for which the purchaser made payments for the same in a span of 2 1/2 yrs, till Jan 2005 the purchaser had still not started the work on the said property, so the vendor approached the purchaser to settle for the second flat some where in mid 2005, the purchaser did not put into writing the amount agreed upon towards the surrender of the second flat, hence in 2007 once the purchaser finished paying about 20,00,000/- is asking for the conveyance wherin as on today the market value of this flat is 2.5 cr
can we get the second flat back from the purchaser on returning his money as there is no agreement signed for the same.or how can we get him to pay the balance
