Legal Question in Real Estate Law in India

mcs act 1960 vs societies act 1860

hello,

my society is registered under maharashtra state cooprative societies act 1960 in mumbai and in our single layout plan, 100 other societies are there reg under same act.

Now some members formed a federation of housing societies

( registered under societies act 1860 ) and affiliated 70% of our societies in the lay out with them.

my Q. is

can societies reg. under mcs act 1960 become members of non cooprative federation reg. under socities act 1860 ? ..is this affiliation lawful - legal or not ?

Apex Society of Societies is permissible in law.

Affiliation depends on each of the society concerned.

There is no legal bar for joining or in forming a Federation. However, it may be optional for your Society to join this federation unless there is any order from RCS.
