Legal Question in Real Estate Law in India

My mom leased the top of her house for me to build, which i did and since moved out from there into another house. I now want to rent the top floor of my moms house but she is not letting me do so.

Who has the legal right to enforce their rights

in case the lease is in your name, you are not allowed to further sub let it. once you moved out, your mother can cancel the lease due to non occupancy.

If there is no written permission from your mom for you to build and no proof that you have spent money for such building, you cannot succeed in law courts. Better settle the matter amicably then.
