Legal Question in Real Estate Law in India
My mother has two brothers and one sister.Her anscestral property is around 62cents of land in kerala. We belong to syrian christian community. My grandmother died 25years back and the property is in the name of my grandfather who died 40 years back. One of her brother is a divorcee with a kid and his mental health was not in good condition. his ex-wife had filed a case asking equal share of property for her and the kid. after that she got remarried to someone else. She later filed a case in her daughter's name for equal share. Can we get a equal share in the property or is it only for the sons. my mother was given a dowry at the time of her wedding 30years back.The property is valued in crores now.younger has agreed to give us also. But can we divide it among ourselves legally due to my uncle's mental condition giving a share to his daughter.
