Municipal Corporations permission for construction not available

Dear Sir,

1.I am a NRI

2I purchased a pent house for my parents in India through loan from HDFC

3.They could not live there even a month due to harrashment for lift and water on 8 th floor.

4. So we decided to sell the same and we have a byer who alos wants to purchase the same through Loan from bank of Baroda.

5.Our all th original paperes i.e sshare certificate, allotment letter, Title clearnce certificate and no due certficate were submited directly by builder to HDFC.

The Bank of Baroda also wants a permission for the construction letter as given by Municipal Corporation (Raja Chjithi as called in Gujarti)

6. Nighter HDFC nor builder has the same

7. We are not able to sell the pent house due to lack of this Raja chithi.

8. We purchased this in good fith with the builder and HDFC as they have legal department to examine all the necessary documents before giving us the loan,

9. Please guide us waht to do as we are pying the loan through nose and not able to live nor not able to sell the property.

Ask the information from Municipal corporation under RTI Act.In caseof need contact with details.Professional charges are applicable.

hi there,

ur problem can certainly be sorted out by u need to delegate the task to someone who could get clearance n get the raja chithi.......legally i see no hurdle in that.

We can obtain a Raja Chitthi as there is no legal barrier to affect in this case. You first obtain information from the Municipal Corporation.

You can file civil and criminal case against the builder. By civil case you can claim amounts paid by you to the builder with interest and damages. By criminal case, builder can be punished for the offence committed.
