Legal Question in Real Estate Law in India
Nature of property?
It is coustomary in India & more commonly among Hindus that parents purchase property in the name of their childern,&, specifically, in the name of elder son. But the intention generally is that the property purchased is NOT 4 THE EXCLUSIVE use of the such child BUT the purchase is 4 the benefit of the Entire Family. I UNDERSTAND THAT THIS IS WELL SETELLED LAW RECOGNISED BY COURTS UNDER ASSUMPTION OF HINDU LAW. A property was purchased by my father in the name of my elder brother in 1960. My brother was not having any source of any indepent income who has now become dishonest.I want 2 know if this property is HUF property held in the name of copercener wELL OUTSIDE THE PREVIEW OF benami act 1988 by virtue of sec.4(3 of the said act
